HC rules in favor of Kings XI Punjab over BCCI

MUMBAI: Kings XI Punjab won for the second time against the Board of Cricket Control in India (BCCI) in less than a week for the Bombay high court ruled in their favor granting them permission to participate in the Indian Premier League.

The appeal bench of the high court favored the Mohali IPL franchisee owned by Preity Zinta, Ness Wadia, Karan Paul and Mohit Burman. The bench of Justices D.Y. Chandrachud and Anoop Mohta paved way over the Board's appeal against the stay over the termination of the Kings XI franchisee agreement granted by a single judge.

The bench declared the BCCI step as "wholly arbitrary" and further reclaimed the termination notice as "anything but fair". The BCCI, on the other hand, seems split over the decision of appealing with the apex court of the country, the Supreme Court.

On Wednesday, Justice Chandrachud not only confirmed the ruling passed by Justice Shiavax Vazifdar but also decalred it perfect in every aspect.

The judges declared that "it was abundantly clear that there was no basis for the notice" given to Kings XI Punjab by the BCCI on 10 October, 2010 blaming the franchisee for committing the "irremedial breach" of contract by altering the company, shareholding pattern and charge after they had won the bid and signed the agreement.

Kings XI had questioned the termination notice and appointed an arbitrator for challenging the notice. Thereafter, retired Judge B. N. Srikrishna was agreed upon as the sole arbitrator acting for both the Kings XI and the BCCI. But he was later rescued due to certain objections by the board.

In the South African victory, Sachin Tendulkar hit a spot that has broken all other records of cricket.

Tendulkar swayed his bat and hit an outstanding century which set grounds as the 50th test century on the fourth playing day of the test match at super sport park on Sunday in Centurion.

India was on a score of 454 with 122.2 overs and eight wickets when the rain began and halted the play during the second inning. India to keep away from an inning defeat required 30 more runs.

With 226 balls Sachin had minted 107 runs and was still unbeaten. The total score of Sachin had 13 fours and a six as well. S Sreesanth was also unbeaten with a score of three.

MS Dhoni the captain and Sachin together put up a fight back where Dhoni struck 90 runs quickly with just 106 balls. They further went on to make 172 runs for seven wickets.

Tendulkar scaled his 50th century and became the world's first batsman to reach this spot and that too with just 197 balls.

Dravid bagged 43 runs with 109 balls and was only caught with an out swinger launched by Morne Morkel. The partnership of Tendulkar and Dhoni was perfect as the two worked well alongside proving the best of both.

Dhoni could have just managed another ten and he would have proved himself but he played well giving the right start to Tendulkar for his outstanding play. Even though Sachin has made his 50th century but there is more for the Indian cricket team.
